Homemade Texas Sends Letter to City of Brackettville

A cottage food producer there was reportedly required to purchase a city permit because she “sells more and is considered a business.”

But here’s the thing: ALL cottage food operators are businesses under Texas law. The law does not create different categories based on whether someone “feels” like a business to local officials. If you qualify under the cottage food statute, local governments may not require permits or fees for your operation.

It was almost as if no one at the City of Brackettville had heard of this newfangled “cottage food law.”
