With the new cottage food law only a couple of weeks old, already misunderstandings about certain provisions are occurring.
In Bexar County, it was reported that a health inspector made a cottage food vendor remove a cottage food product from her shelves because the labels of said product did not include a DSHS Cottage Food License number.
Of course, this is an incorrect application of SB 541; the DSHS Cottage Food License number is optional and only required if the operator wants to use it in lieu of their home address on the label.
A cottage food operator is not required to register or use a DSHS Cottage Food License number on their labels in order to sell their food at wholesale through a cottage food vendor.
