In 2025, the Texas Legislature said, essentially, “No permits for cottage food producers. We’re serious this time.”
The City of Devine apparently heard, “How about a permit, a $1,000 bond, a criminal background check, three personal references, and a sworn and notarized signature?”
Yes, ladies and gentlemen, this is how things are going out there in some Texas cities.
The City does waive its $30 permit fee for cottage food producers. But a free permit is still a permit, and state law says local governments may not require cottage food producers to obtain any type of license or permit to produce or sell food.
So, once again, Homemade Texas and the Farm and Ranch Freedom Alliance have sent a letter to city leaders requesting that they discontinue use of the solicitor permit for cottage food producers and confirm within 10 days that they have done so.
